Welcome to Flareyo. By accessing or using our platform at flareyo.com, you agree to be bound by these Terms of Service. Please read them carefully. If you do not agree, do not use Flareyo.

Flareyo is currently operated as a sole proprietorship and intends to incorporate as a limited liability company (LLC). References to "Flareyo", "we", "us", or "our" refer to the Flareyo business and its operators.

1. Description of Service

Flareyo is an AI-powered visual content platform that allows users to generate social media ad creatives and ecommerce product images from uploaded photos. Features include background removal, AI image generation, and multi-platform output formatting.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

2. Eligibility

You must be at least 18 years old to use Flareyo. By creating an account, you represent that you meet this requirement and that the information you provide is accurate and complete.

3. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at flareyo@gmail.com if you suspect any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Credits and Billing

Flareyo operates on a credit-based system. Free accounts receive 50 lifetime credits at no cost. Paid plans are billed monthly and provide a set number of credits per billing period.

Credits do not roll over between billing periods unless otherwise stated. Payments are processed securely through Stripe. By subscribing to a paid plan, you authorise us to charge your payment method on a recurring monthly basis until you cancel.

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial months or unused credits.

5. Acceptable Use

You agree not to use Flareyo to:

• Upload or generate content that is illegal, defamatory, obscene, or infringes on the rights of any third party
• Generate images of real people without their consent
• Produce content that promotes violence, hatred, or discrimination
• Attempt to reverse-engineer, copy, or reproduce our AI models or platform infrastructure
• Use automated tools to scrape or extract data from the platform
• Resell or sublicense access to Flareyo without our written permission

We reserve the right to remove content and suspend accounts that violate these guidelines without prior notice.

6. Intellectual Property

Your content: You retain ownership of all images and product photos you upload to Flareyo. By uploading content, you grant us a limited, non-exclusive licence to process and display your content solely to provide the service.

Generated outputs: Images generated by Flareyo using your inputs are owned by you, subject to the limitations of the AI models used. We do not claim ownership of your generated outputs.

Our platform: The Flareyo name, logo, interface, and underlying technology are our intellectual property. You may not copy, reproduce, or create derivative works from them without our written permission.

7. Free Plan and Watermarks

Free plan users receive outputs with a Flareyo watermark applied. Upgrading to a paid plan removes the watermark. You may not remove or obscure watermarks on free plan outputs through any means other than upgrading your account.

8. Disclaimer of Warranties

Flareyo is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or produce results that meet your specific requirements.

AI-generated outputs may not always be accurate, appropriate, or commercially viable. You are solely responsible for reviewing and approving any content before use.

9. Limitation of Liability

To the fullest extent permitted by law, Flareyo and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities.

Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid to Flareyo in the three months preceding the claim.

10. Third-Party Services

Flareyo integrates with third-party services including Stripe (payments), Supabase (infrastructure), and AI model providers. Your use of these services is also subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

11. Changes to These Terms

We may update these Terms of Service from time to time. We will notify registered users of material changes by email or by displaying a notice within the platform. Continued use of Flareyo after changes take effect constitutes your acceptance of the revised terms.

12. Governing Law

These terms are governed by the laws of the United States. Any disputes arising from these terms or your use of Flareyo shall be resolved through binding arbitration or in the courts of competent jurisdiction.
